29 U.S.C. § 794 et seq. (504 of Rehabilitation Act of 1973)
34 C.F.R. Part 104 (Implementing Regulations)

Rationale: I.S.D. 834 is legally and ethically responsible to identify, evaluate and provide free appropriated education services for eligible students within the intent of Section 504 of the Rehabilitation Act of 1973. The Board of Education recognizes that students may be protected from discrimination and be eligible for services under the provision of Section 504 even though they do not require an Individual Education Plan (IEP) under the provisions of the Individuals with Disabilities Education Act.
